1. Your Relationship with Us
This Customer Agreement ("Agreement") between you ("Subscriber," "you" or "your") and PlayxmRadios LLC ("Company," "us," "our" or "we") applies to your paid, trial, advertising-supported or other subscription ("Subscription") to our satellite radio service ("Satellite Radio"), our streaming service ("Streaming"), and any other service we offer.
2. Subscriptions
Subscriptions are available in a variety of service tiers and packages which we refer to in this Agreement as "Plans." Payment options vary by Plan. The subscription plan you choose will automatically renew and you will be charged at then-current rates for that plan until you cancel. Credit card required. Applicable tax and other fees may apply.
3. Automatic Renewal & Cancellation
Your subscription will automatically renew at the end of each billing period. You may cancel at any time at least 24 hours prior to renewal; cancellation is effective at the end of your current billing period. There are no refunds except as provided in this Customer Agreement.
4. Changes to Terms
We reserve the right to change this Agreement at any time. Any changes will be effective upon posting of the revisions at Playxmradios.site. Your continued use of the Services after such changes constitutes your acceptance of the new terms.
5. Dispute Resolution
Any dispute between us, unless provided otherwise herein, will be resolved by binding arbitration on an individual basis as outlined in Section 13 below. You are waiving your right to go to court, including the right to a jury.
6. Limitation of Liability
To the fullest extent permitted by law, PlayxmRadios and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use or inability to use the Services.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles.
